What happened: HBCU scholarships

McDonald’s USA launched Black & Positively Golden in 2019, by its own account. On June 25, 2020, it announced a $500,000 HBCU scholarship fund with the Thurgood Marshall College Fund. On November 29, 2022, it said awards would rise to $1 million for 2023–2024.

What happened: Black franchisee lawsuits

Herb Washington, a Black franchisee with more than a dozen restaurants, alleged that white owners were treated better, that he was denied stores in more affluent areas, and that Black owners averaged about $700,000 less in annual sales per store. AP reported a $33.5 million payment for 13 restaurants to end that suit. McDonald’s called the sum a fair price, said it was confident in its case, and said “discrimination has no place at McDonald’s.” Washington left the system.

AP also reported that in September 2020 more than 50 Black former franchise owners sued with similar claims. Reuters reported on October 4, 2022, that a Chicago federal judge dismissed that lawsuit, with leave to amend. Dismissal with leave to amend is not a trial verdict that the allegations were false.

The Cookout read

Mixed. Scholarship branding and franchisee allegations can both be true as public records. A buyout is not a jury finding.
