What happened
Lloyd Brown, a Black Foot Locker manager, sued under Title VII alleging the chain would promote him into “ethnic” stores but not into “non-ethnic” ones. A jury found intentional racial discrimination. In Brown v. Kinney Shoe Corp., 237 F.3d 556 (5th Cir. 2001), the court of appeals held the evidence supported the failure-to-promote claim, rejected constructive discharge, and remanded for a new damages trial.
The Cookout read
Concern. A company sorting stores into “ethnic” and “non-ethnic” lanes for Black managers is the receipt. This is a jury finding upheld on liability—not a rumor and not a DOJ consent decree. Damages were fought on appeal; the discrimination finding was not wiped out.
